Please read these Terms of Service ("Terms") carefully before using the Callio service ("Service") operated by Callio ("us", "we", or "our"), accessible via callio.me.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Service Description
1.1 AI Receptionist: Callio provides an AI-powered virtual receptionist designed to answer phone calls, capture lead information (including name, contact details, and nature of enquiry), and send notifications to the subscriber.
1.2 Virtual Nature: You acknowledge that the Service is provided by an automated artificial intelligence system and not by human operators.
1.3 UK Phone Number: As part of your subscription, we provide a UK-based phone number for your business use within the Service.
1.4 No Emergency Services: The Service is not a replacement for emergency services. It must not be used to contact or manage emergency situations. Callers in need of urgent assistance should be directed to dial 999 or 111 directly.
1.5 Best-Effort Availability: While we strive for high uptime, the Service is provided on a "best-effort" basis. We do not provide a guaranteed Service Level Agreement (SLA) during the current phase of operation.
2. Eligibility
2.1 Location: The Service is intended for use by businesses operating within the United Kingdom only.
2.2 Age: You must be at least 18 years of age to subscribe to Callio.
2.3 Accuracy: You must provide current, accurate, and complete information during the registration process and keep your account information updated.
3. Subscription and Billing
3.1 Recurring Fees: The Service is billed on a monthly subscription basis. All payments are processed securely via Stripe.
3.2 Usage Limits: Subscriptions include a specific allowance of call minutes per month.
3.3 Overage: If you exceed your monthly minute limit, the Service will continue to answer calls, but you will receive warnings via the dashboard or email. We reserve the right to limit service or require a plan upgrade for consistent overages.
3.4 Failed Payments: If a recurring payment fails, we provide a short grace period. Failure to settle the balance within this period will result in the immediate suspension of your Service and the potential release of your assigned phone number.
4. 14-Day Money-Back Guarantee
4.1 Applicability: New subscribers are entitled to a full refund of their first month's subscription fee if requested within 14 days of the initial sign-up.
4.2 Exclusions: The refund applies only to the subscription fee. Any costs already incurred by Callio for the provisioning or leasing of your specific UK phone number are non-refundable and will be deducted from the total refund amount.
4.3 Process: To request a refund, you must contact us via email within the 14-day window at support@callio.me.
5. Phone Numbers
5.1 Leasing: UK phone numbers provided by Callio are leased to you for the duration of your active subscription. You do not own the phone number.
5.2 Release on Cancellation: Upon cancellation or termination of your subscription, the phone number will be released back into the general pool.
5.3 No Retention Guarantee: We cannot guarantee that a specific number will remain available to you if you allow your subscription to lapse or if you cancel and later attempt to resubscribe.
5.4 No Porting: Numbers provided by Callio are integrated into our platform and cannot be transferred or "ported" to another service provider.
6. Acceptable Use
6.1 Prohibited Activities: You agree not to use the Service for:
- Any illegal or fraudulent activity.
- Harassment, abuse, or the transmission of defamatory content.
- Spam, unsolicited telemarketing, or automated "robocalling" schemes.
- Adult content services or "premium rate" style lines.
- Directing callers to use the Service for life-critical or emergency reporting (999/111).
6.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials.
7. Data and Privacy
7.1 Privacy Policy: Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your data.
7.2 Call Recordings: You acknowledge that calls may be recorded and transcribed to provide the Service.
7.3 Compliance: You are solely responsible for ensuring that your use of call recording and transcription complies with relevant UK laws, including informing your callers that they are being recorded if required by your specific industry regulations.
8. Intellectual Property
8.1 Ownership: Callio retains all rights, title, and interest in the Service, including the AI technology, software, branding, and proprietary processes.
8.2 User Data: You retain ownership of the business data and lead information captured by the Service on your behalf. You grant us a licence to process this data solely to provide and improve the Service.
9. Limitation of Liability
9.1 "As Is" Basis: The Service is provided "as is" and "as available" without any warranties, express or implied.
9.2 Lead Quality: We do not guarantee the accuracy of information captured by the AI or the quality of leads generated.
9.3 Liability Cap: To the maximum extent permitted by law, Callio's total liability for any claim arising out of these Terms shall not exceed the total amount of fees paid by you to us in the three (3) months preceding the claim.
9.4 Consequential Loss: We shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or business interruption.
10. Termination
10.1 By User: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle.
10.2 By Callio: We may suspend or terminate your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
10.3 Notice of Termination: We reserve the right to discontinue the Service by providing 30 days' notice to your registered email address.
11. Changes to Terms
11.1 Updates: We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date.
11.2 Acceptance: Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
12. Governing Law
12.1 Jurisdiction: These Terms shall be governed and construed in accordance with the laws of England and Wales.
12.2 Disputes: Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
